SUNWATER SPA REQUIRES THE EXECUTION OF THIS WAIVER AND RELEASE PRIOR TO USE OF ITS FACILITIES

By signing this Spa Release of Liability and Waiver, I am confirming that I recognize that there may be inherent risks associated with using hot tubs, pools, and saunas, and in utilizing SunWater Spa’s facilities, participating in programs, and/or receiving treatments at the Spa.

  • Children 14 and older are welcome at the spa, however, each minor must be accompanied by an adult and must meet the height requirement of 42”. Minors are not permitted to use the saunas. This waiver covers both me and any minor that accompanies me.
  • I acknowledge and agree that I am responsible for my own health; that the Spa associates and/or technicians are not health care practitioners and cannot be expected to diagnose and/or treat individual health problems.
  • I understand that I am responsible for discussing any questions that I may have concerning any health conditions, including pregnancy, throughout the use of the facilities or treatment at the Spa, and should health-related symptoms occur I will cease my participation and inform the Spa personnel of the symptoms.
  • If I have reason to believe that medical clearance must be obtained prior to participation in any Spa treatments, therapies, hot tubs, pools, sauna, or facility equipment, I agree to first consult a physician and obtain written permission from a physician prior to the commencement of any program, treatment, or activity.
  • By voluntarily choosing to receive Spa-related treatments and/or participate in Spa-related activities and programs, I warrant that to the best of my knowledge, I have no disability, impairment, or ailment that prevents me from receiving such treatments and/or engaging in such participation.  I will inform the Spa if I am pregnant so that accommodations may be made to protect my health and safety.
  • I understand the use of alcohol is prohibited at SunWater Spa and we encourage all guests to stay fully hydrated.  For my safety, I understand that no glass containers are permitted, and sitting on the edge of the tubs is prohibited.
  • I understand that SunWater Spa is a 100% drug, alcohol, tobacco, smoke, and firearm-free facility and if I appear to be under the influence of any intoxicating substance, or in possession of any firearm, I will be asked to leave the premises without receiving a refund.
  • I understand that audio and video recording may occur in and around the Spa and I release SunWater Spa and its employees and waive all rights to any claims for payment or royalties in connection with any use of these materials. I also waive any right to inspect or approve any photo, video, or audio recording taken.
  • I understand that the pathways and stairs located throughout the properties pose a potential hazard due the altitude and the many steps required to navigate our facility.

I hereby release the Spa and its affiliates, owners, members, officers, employees, agents, and successors, and assign and waive any and all claims, liabilities, property damages, physical damages or personal injuries that I may receive directly or indirectly from receiving Spa related treatments, utilizing the Spa facilities and/or participating in the programs or activities offered by the Spa.
